Join the Victim Services Program as we kick off Domestic Violence Awareness Month with a 5k run/walk. The scenic, 3.1-mile course will feature both road and trail paths. Grab and go lunches will be available to all participants after completing the course.

To ensure safety for all participants, we will be closing the entrances to Rodger's Lake promptly at 8:45 AM. Please be onsite by 8:45 AM.

This year, instead of t-shirts, participants will receive a Yeti water bottle.

Dress accordingly for the weather. We will hold the event as long as it is safe to complete the event. In the event of heavy rain or thunderstorms, the event will be cancelled. Please check social media for any weather related updates.

AUTHORIZATION TO PHOTOGRAPH

(Use for Adult) For good and valuable consideration, the receipt and sufficiency of which are acknowledged, the below identified signatory (“Participant”) on behalf of the Participant and all personal representatives, successors, and heirs of the Participant, hereby agrees as follows: 1. The Participant acknowledges that the Pokagon Band of Potawatomi Indians Band (“Band”) may take or permit to be taken on behalf of the Band, photographs and video and audio recordings (“Recordings”) of the Participant in connection with the Participant participating in Band programs, events or initiatives (“Events”); and: (a) grants the Band the absolute right and permission, without compensation, to take, use, post, display, publish, distribute, transmit, and otherwise disseminate the photographs and Recordings of the Participant, and the Participant’s name and likeness, in whole or in part, whether distorted in character or form, and without restriction as to change or alteration, for any and all purposes whatsoever, including but not limited to, for purposes of marketing, advertising, publicizing and promoting of Events or the Band in any form of media (“Permitted Use”); (b) consents to the use of any text or other published matter or image in connection with any Permitted Use; (c) waives any right to inspect or approve the photographs, Recordings, any use of the Participant’s name or likeness, and any text or other published matter in connection with any Permitted Use; and (d) relinquishes and grants the Band all rights, title and interests in and to the photographs and Recordings. 2. To the fullest extent permitted by law, the Participant: (a) forever releases, waives, discharges and covenants not to sue the Band and its officials, employees, representatives and agents (“Released Parties”) from any and all claims, actions, suits, damages, liabilities, costs, expenses, and fees of every nature whatsoever which arise, directly or indirectly, in connection with the Band exercising any right granted pursuant to Paragraph 1 above; and (b) shall indemnify and hold the Released Parties harmless from and against any and all damages, liabilities, awards, settlements, costs, expenses, and fees of every nature whatsoever, including not limited to, reasonable attorney fees and litigation costs, which arise or are incurred, directly or indirectly, in connection with any claims, actions or suits of every nature whatsoever brought in connection with the Band exercising any right granted pursuant to Paragraph 1 above. 3. This Authorization to Photograph (“Agreement”) shall be construed pursuant to the laws of the Band. Nothing contained in this Agreement shall be construed to waive the sovereign immunity of the Band or any other Released Party. If a court of competent jurisdiction shall adjudge any provision of this Agreement to be invalid, such judgment shall not affect or invalidate any other provision of this Agreement. The Participant acknowledges that: (a) this Agreement is legally binding and enforceable; (b) the Participant reviewed this entire Agreement; and (c) the Participant entered into this Agreement willingly, without duress, and with full knowledge of its consequences. This Agreement is operative as of the date written below.

LIABILITY WAIVER FOR A PARTICIPANT THAT IS A MINOR

In consideration for Pokagon Band of Potawatomi Indians (“Band”) permitting the below identified minor (“Minor”) to participate in the 2022 Light The Way 5K (“Event”), and for other good and valuable consideration, the receipt and sufficiency of which are acknowledged, the below identified parent, guardian, or custodian of the Minor (“Parent”), on behalf of the Parent and the Minor and their respective personal representatives, successors, assigns and heirs, agrees as follows. 1. The Parent consents to the Minor attending and fully participating in the Event. The Parent (not the Band) shall be solely responsible for assessing the Minor’s condition, health, skill, and ability to safely attend and/or participate in the Event and for determining whether the Minor will attend and/or participate in the Event. The Minor shall retain the right to stop participating in the Event at any time, and the Parent shall advise the Minor of such right before the Event. 2. The Parent acknowledges that the Minor attending and/or participating in the Event may involve certain risks or dangers, including without limitation, exposure to, infection from, and spreading of, the COVID-19 virus, which may result in injury, bodily harm, disability, and death, and that there may be other risks that are not known or reasonably foreseeable at this time (collectively “Risks”). To the fullest extent permitted by law, the Parent accepts and solely assumes all Risks, and all responsibility for all losses, costs, expenses, and damages of any nature whatsoever, which are incurred, directly or indirectly, in connection with the Minor attending and/or participating in the Event. 3. To the fullest extent permitted by law, the Parent forever releases, waives, discharges, and covenants not to sue the Band and its officials, employees, representatives, agents, and volunteers (collectively, “Released Parties”) from any and all claims, actions, suits, damages, liabilities, costs, expenses, and fees of every nature whatsoever which arise, directly or indirectly, in connection with the Minor attending and/or participating the Event. 4. To the fullest extent permitted by law, the Parent shall indemnify and hold the Released Parties harmless from and against any and all damages, liabilities, awards, settlements, costs, expenses, and fees, including without limitation, reasonable attorney fees and court costs, which arise, directly or indirectly, from any claims, actions or suits brought in connection with the Minor attending and/or participating in the Event, including without limitation, any claims, actions or suits brought by or on behalf of the Minor. 5. This Participation Agreement (“Agreement”) shall be construed pursuant to the laws of the Band and, to the extent not inconsistent with Band law, the laws of the State of Michigan, but excluding any Michigan law that would render any part of this Agreement unenforceable or invalid. Nothing contained in this Agreement shall be construed to waive the sovereign immunity of the Band or any other Released Party. If a court of competent jurisdiction shall adjudge any part of this Agreement to be unenforceable or invalid, such judgment shall not affect any other part of this Agreement. 2 6. The Parent acknowledges and agrees that: (a) this Agreement is legally binding and enforceable; (b) the Parent read this entire Agreement before signing; (c) the Parent had the opportunity to consult with an attorney regarding this Agreement; (d) the Parent entered into this Agreement willingly, without duress, and with full knowledge of the consequences; and (e) this Agreement is effective and shields the Released Parties, including the Band, from liability to the extent set forth in this Agreement. This Agreement is effective on the date of the Parent’s signature.
