The Gaming Commission will accept requests from Patrons to voluntarily exclude themselves from the Tribe’s Gaming Operation. Any person who requests to be placed on the Voluntary Exclusion List shall submit a request to the Gaming Commission. The completed and signed request form along with the requestor’s photograph shall be maintained by the Gaming Commission. A copy of the request form and photograph of the requestor shall be made available to the Tribe’s Gaming Operation. Once the requestor has been photographed and completed the request form, the requestor shall be placed on the Exclusion List.

Patrons placed on the Voluntary Exclusion List may not return to the Gaming Operation until their written request for the exclusion to be rescinded is submitted to the Gaming Commission and the Gaming Commission has provided the person with written permission to return. The Excluded Person’s name will then be removed from the Exclusion List and their privileges shall be restored.

Length of Exclusions and Requests for Reinstatements:

  • On the first request to be voluntarily excluded, the Patron shall wait a minimum of two (2) years before requesting to be removed from the Exclusion List; and
  • On the second request to be voluntarily excluded, the Patron is excluded for life. The Patron’s name will be placed on the Exclusion List.

NOTICE OF EXCLUSION

The Pokagon Band of Potawatomi Indians (“PBOPI”) is a federally recognized Indian tribe based in southwestern Michigan and northwestern Indiana which, under the Pokagon Gaming Authority, operates multiple gaming facilities known as Four Winds Casinos.

The Pokagon Band Gaming Commission (“PBGC”), an independent governmental subdivision of the PBOPI, is responsible for ensuring that all gaming conducted within PBOPI jurisdiction is in full compliance with all PBOPI and federal laws and regulations.

On July 2, 2021, the U.S. Department of the Interior published its approval of a Compact (“Compact”) between the PBOPI and the State of Indiana permitting certain, previously unauthorized forms of gaming to commence on PBOPI trust lands located in in South Bend, Indiana.  Section 10(F) of the Compact requires that the Pokagon Band eject from Four Winds South Bend any person participating in the Indiana Gaming Commission’s (“IGC”) voluntary exclusion program under IC § 4-33-4-3 (“IGC Voluntary Exclusion Program”).  Section 10(G) of the Compact requires the exclusion from Four Winds South Bend of any person named on the IGC’s exclusion list under IC § 4-33-4-7(“IGC Exclusion List”).

Let this Notice serve as acknowledgment that, by being identified as a person participating in the IGC Voluntary Exclusion Program or named on the IGC Exclusion List, you are excluded and prohibited from entering any Four Winds property located in the state of Michigan or Indiana, including the parking lots, food and entertainment venues, and all other areas located on any Four Winds property.  Such exclusion and prohibition shall remain in effect until the PBGC issues written notice that it has determined that you are no longer excluded and prohibited from entering any Four Winds property located in the state of Michigan or Indiana.  Such determination will be based on the PBGC receiving documentation acceptable to the PBGC verifying your removal from the IGC Voluntary Exclusion Program or the IGC Exclusion List.  Violation of the PBGC exclusion regulations or Four Winds exclusion policies shall be considered a trespass subject to arrest and/or criminal prosecution.
